Statement of Acceptance of the General Terms and Conditions

INTRODUCTION

General terms and conditions of use (hereinafter: “General Terms and Conditions” of the web service for online payment of tourist tax for boaters (hereinafter: “Service”)are set out in accordance with the applicable regulations of the Republic of Croatia.

The tourist tax for boaters is levied under the Tourist Tax Act (OG 52/19, 32/20, 42/20) and the Regulations on the Amount, Method of Payment and the Distribution of the Tourist Tax for Charter Vessels, Ships for Multi-Day Cruises and Persons Staying on the Vessel (Boaters) and the Method of Payment of the Tourist Tax for Cruise Ships in International Maritime Transport and International Transport in Inland Waters (OG 73/2020).

These General Terms and Conditions apply to the use of the Service on the web address www.nautika.evisitor.hr including all subpages and to the payment of fees available there. The person visiting the Service, i.e. registering and carrying out the payment (hereinafter: “User”) shall read these General Terms and Conditions before use. The User’s consent to the General Terms and Conditions provided here is a prerequisite for making the payment.

GENERAL TERMS AND CONDITIONS OF USE OF THE SERVICE

The Service available on the web address www.nautika.evisitor.hr was established by the Croatian National Tourist Board, whose registered office is located at Iblerov trg 10/IV, Zagreb, Croatia, PIN 72501368180 (hereinafter “CNTB“) and which can be contacted for queries about this service on the e-mail address nautika@htz.hr.

CNTB provides the Service on the website at www.nautika.evisitor.hr , which consists of providing the service of tourist registration and payment of the appropriate fee and content management related to such registration.

All boaters are required to pay a tourist tax prior to vessel departure.

The User accepts these General Terms and Conditions electronically by selecting the appropriate fee in the Service and after accepting the necessary statements. CNTB also advises the User to read the Rules on Data Protection and Privacy as well as the Rules on Cookies, considering they also apply to the use of the Service.

The User agrees to use the Service exclusively in accordance with the legal regulations for reviewing published content, payment of fees, submission of legally valid applications and communication with HTZ.

The services provided by CNTB through the Service do not include costs born by the User for using computer equipment and other electronic equipment (electronic devices) and services for access to the Service. CNTB is not be liable for phone and data traffic expenses or any other expenses that may arise during the payment or viewing the content of the Service and using the services available on the Service.

CHANGES TO THE GENERAL TERMS AND CONDITIONS

The version published on this page is always deemed to be the valid version of the General Terms and Conditions. In case of disputes, the version valid at the time of registration/payment and the one which the User had agreed to during registration shall be applied.

CNTB informs that there is a possibility of changing the General Terms and Conditions in order to comply with the changes in the law and/or business processes.

CNTB reserves the right to alter or terminate (temporarily or permanently) as well as to change the content of the Service, without prior approval or notice, with the application of good business practices.

OBLIGATION TO REGISTER AND CREATING A PAYMENT OBLIGATION

While viewing the content of the Service, the User is free to choose the method of registration with the appropriate fee amount and add it to the cart. This action is in no way binding. After the User selects the appropriate tax and is certain that they want to make the payment, they start the application process during which they enter all necessary information, confirm their consent to the General Terms and Conditions, and depending on the chosen method, pay the tourist tax. The actions performed and confirmed by the User during the submission process of submitting the application are considered a registration requirement and are legally binding as such.

By submitting the application in the Service, the User confirms their will to pay the tourist tax in accordance with the information provided in the application form. Only after receiving the confirmation of payment by e-mail is the obligation to register and pay the tourist tax considered to be fulfilled.

CNTB reserves the right to reject a received application if it cannot carry it out due to exceptional circumstances. CNTB is not obliged to carry out a transaction on the basis of a received application in the event that it cannot fully fulfil the obligations arising from the application.

AMOUNT AND PAYMENT METHOD

All fee amounts are denominated in Euro (EUR). The amounts of fees are the same for all payment methods and are visible on the tourist tax selection page and the cart during the payment of the tourist tax. The amounts of fees are regulated by special regulations, as follows:

1.The Tourist Tax Act (OG 52/19, 32/20, 42/20)

2.The Regulations on the Amount, Method of Payment and the Distribution of the Tourist Tax for Charter Vessels, Ships for Multi-Day Cruises and Persons Staying on the Vessel (Boaters) and the Method of Payment of the Tourist Tax for Cruise Ships in International Maritime Transport and International Transport in Inland Waters (OG 73/2020).

In exceptional cases of administrative error in stating the amount of the fees on the Service website, CNTB is not obliged to register and receive the payment under unfavourable conditions. If such a case occurs, CNTB will allow payment in the appropriate amount of the tourist tax, without the obligation to accept such a possibility. If the User does not accept this, the paid amount will be returned to the User if the payment by the User had already been completed.

All payments will be made in the Croatian currency. The charged amount on the User’s credit card account is converted into the local currency according to the exchange rate of the credit card association, or the conditions of the credit card company.

The User can make the payment by credit or debit card (Visa, MasterCard, Maestro, American Express, Diners, etc.) upon concluding the application in the Service, by payment to transaction account of the Croatian National Tourist Board using internet banking.

The contracting partner ensuring the technical correctness and safety of the payment card application is the company WEB STUDIO d.o.o. applying the highest data protection standards – the Secure Socket Layer (SSL) protocol with 128-bit data encryption and the MD5 algorithm. The ISO 8583 protocol ensures that the data transfer between systems and credit card company authorisation centres is carried out over a private network, which is protected from unauthorised entry using a double firewall.

CNTB is obliged to ensure that the information about the tourist tax is true and is obliged to provide complete information on the payment of the tourist tax.

SERVICE AVAILABILITY

CNTB cannot guarantee the availability of the Service at all times and on all types of devices and browsers or communication links. The Service may be temporarily or for an extended time, fully or partially unavailable due to technical or other reasons (maintenance, error, unavailability of communication links, force majeure, decision of the public authority, etc.). CNTB cannot be deemed liable for any damage arising from the unavailability of the Service. CNTB may modify the Service at any time and in any way and form, which includes changing the visual identity, design and architecture, content management system and other dedicated solutions related to the functioning of the Service.

RIGHT TO CHANGE THE CONTENT

CNTB reserves the right to change, cancel (temporarily and permanently) any content or service on the Service, without prior notice and at any time, and cannot be held responsible for any damage caused by any such action.

MANNER AND PURPOSE OF USING THE CONTENT

CNTB grants the User limited, non-transferable and non-exclusive permission to browse, print, copy or otherwise use the content of this Service, exclusively for their personal and non-commercial use or the purpose of promoting Croatia as a tourist destination, under the condition that they do not change or impair it in any way and that they state CNTB as the source and the name of the author next to the downloaded content.

MODES OF ACCESS TO THE SERVICE AND THE PUBLISHED CONTENT

An unlimited number of persons with appropriate computer equipment and an internet connection can access the Service. CNTB reserves the right to temporarily or for an extended time, fully or partially, limit the mode and possibility of access to the Service in particular cases (maintenance, error, unavailability of communication links, force majeure, decision of the public authority, etc.) to all Users as well as to a particular User or group of Users. In any of the aforementioned cases, CNTB cannot be deemed liable for any damage caused by limiting access to the Service and the published content.

While accessing the Service and the content, the User must use standard technical equipment and regular standards and modes of accessing the Service. Content published in the Service can only be browsed by using permitted information technology methods, in the manner and to the extent that is usual for the User as a natural person. Any other manner of searching through and/or using content that bypasses the protected systems and information technology applications or uses certain applications or tools to simultaneously download a quantity of data that is not usual for the User as a natural person, presents a violation of the protected right of HTZ, for which the User bears appropriate material, criminal and misdemeanour liability.

PRIVACY PROTECTION AND COLLECTING USER DATA

CNTB undertakes to protect the privacy of personal data of all Service Users, and to handle the data in accordance with the General Data Protection Regulation of the European Parliament and the Council No. 2016/679-Regulation and the Act on the implementation of General Data Protection Regulation (OG 42/2018), or other legal regulations, in a way that collects only the statutory, basic data on Users and persons in respect of whom the tourist tax is paid, which are necessary for the fulfilment of the obligations of HTZ; informs Users about how to use the collected data, regularly provides the Users with an opportunity to choose how their data is being used.

All User data is securely stored and is availably only to CNTB employees who need this data to perform their work. All CNTB employees and business partners are responsible for respecting the principles of privacy protection. Data from the registration and application process, as well as other data on the User will not be disclosed to a third party nor will it be available to a third party, unless such an obligation is regulated by applicable regulations.

WSPay as the executor of credit card authorisation and billing handles personal data as a processor and in accordance with the General Data Protection Regulation of the European Parliament and the Council No. 2016/679 and the strict rules of the PCI DSS L1 regulation on the protection of data entry and transfer. WSPay uses 256-bit encryption SSL certification and the TLS 1.2 cryptographic protocol as the highest levels of protection when entering and transferring data. Personal data used for the purpose of authorisation and billing, i.e. for fulfilling the obligations from or under the Contract, is considered confidential data.

The personal data of the payer is required for the payment of the tourist tax (authorisation and billing). WSPay does not process or use personal data except for the purpose of carrying out the authorisation and billing agreement. WSPay guarantees the fulfilment of all conditions set by the applicable regulations on personal data protection for personal data processors, and in particular the taking of all necessary technical, organisational and security measures, and this is especially confirmed by the PCI DSS L1 certificate.

In accordance with the law, CNTB processes certain User data obtained during the use of the Service. CNTB processes the data collected in this way primarily for the purpose of improving the functionality of the Service and their content in order to direct and adapt them further to users, and may process it for other activities that include the promotion of Croatian tourism and CNTB tasks, but is not limited to:

making User habit and preference analyses for the market research and website optimisation purposes (including analyses obtained through third party tools, e.g. Google Analytics, etc.);

adaptation of the Service to new or different technical solutions or needs of the User;

optimising intuitiveness and easier use and access to content.

For the purpose of collecting particular activity or User request data, CNTB may use special small files, or cookies, which are recorded on the User’s computer and serve to achieve a specific purpose. In accordance with the aforementioned, CNTB shall also publish an appropriate Cookie Policy which shall be published on the Service and which the Users become acquainted with when accessing it. The Cookie Policy describes which types of cookies CNTB uses and to what purpose, and instructs the User on the possibility to reject the use of cookies or to accept it, thus agreeing to the manner and purpose of their use and in this case, CNTB cannot be held liable for any damage caused by storing and using cookies in the manner and for the purpose to which the User has agreed to by accepting the Cookie Policy.

The Cookie Policy is published separately from these General Terms and Conditions, but forms an integral part thereof.

When accessing the Service, CNTB may temporarily store the User’s IP address. IP addresses may be stored and used exclusively for the purpose of monitoring the User’s activities on the Service (activity log) for the purpose of detecting violations of legal regulations or these General Terms and Conditions, identifying illegal or other unacceptable actions. IP address and User activity monitoring data may be provided to the competent public authorities at any time in order to determine any legal liability of the User based on the law. The IP address and data on the User’s activities are stored temporarily.

CNTB undertakes, in accordance with the applicable regulations and these General Terms and Conditions, to protect the privacy of the User of this Service, except in the case of violation of these General Terms and Conditions or the User’s conduct in a manner contrary to legal regulations.

OPTING OUT

According to the default Service search settings, Google Analytics tracks the User in order to generate anonymous statistical data used for improving costumer experience.

DO NOT TRACK ME PREFERENCES

The Do Not Track feature enables the Users to opt out, so that Service cannot track them for any purposes, including the use of service analytics, advertising networks and social platforms. Do Not Track options are available in a various browsers including: Firefox, Internet Explorer, Chrome, Safari i Opera

  • if the User enables the Do Not Track option in your browser, Google Analytics will respect their choice;
  • If the User enables the Do Not Track Me option, they will not be tracked. This is an addition to excluding the collection and analysis of data for producing statistical data for the CNTB website;
  • if the User did not enable the Do Not Track Me option, but decides to opt out, the piwik_ignore cookie will be stored in the User’s browser. Google Analytics will not track any Users that have turned on the piwik_ignore cookie.
  • if the User disables all cookies on their browser, CNTB will continue to collect some general search data (e.g. number of users on the Service), but they will be less accurate and the User’s visits will not be tracked (Piwik cookies are not used).

INTELLECTUAL PROPERTY RIGHTS AND CONTENT OWNERSHIP

The content published on the Service is protected by the regulations of intellectual property rights, so any unauthorised use may present the basis for initiating proceedings for the protection of rights towards the User by CNTB or a third party who is the authorised copyright holder.

Any modification, publishing, transmitting, reproducing, participating in the transfer or sales, creating derivatives or in any way exploiting any content, fully or partially, is not allowed without the explicit written consent from CNTB or the holder of the relevant right. The User is not authorised to download, duplicate, modify, edit, distribute, display, delete, send, sell, resell, adapt or modify copyrighted materials in any way except for the purpose of their personal use.

For the avoidance of any doubt, CNTB expressly reserves and does not transfer to the User any rights in relation to the content of the Service, and prohibits the use of the content of the Service except as provided in these General Terms and Conditions.

USER RESPONSIBILITY

The Service User entering data via the appropriate web form bears all material and criminal liability for the consequences of misrepresentation and the quality of data upon registration (same as specified for the User in these General Terms and Conditions) and is obliged to compensate any damage (material or non-material) to the person in whose name and on behalf of whom they are misrepresenting according to the regulations of the law of obligations.

SEVERABILITY

If any of the provisions of these General Terms and Conditions are subsequently found to be null and void, this fact shall have no effect on other provisions of these General Terms and Conditions which remain valid.

SETTLING DISPUTES AND THE GOVERNING LAW

Any possible disputes in relation to these General Terms and Conditions, including the disputes related to their establishment, content or termination will aim to be resolved in an amicable manner, and in case of failure to do so, the competence of the court in Zagreb will be contracted.

These General Terms and Conditions have been drawn up in accordance with Croatian law and Croatian law applies to them and to disputes arising from them without applying the provisions of Croatian law on referral (renvoi) to the extent permitted by international law.

CHANGES TO THE GENERAL TERMS AND CONDITIONS

CNTB reserves the right to change these General Terms and Conditions at any time and is not liable for possible consequences resulting from such changes. These changes take effect on the day of publication on the Service.
